Minor Injury Cap & Insurance Compensation

When you are injured in a car accident, you may be entitled to compensation for:

1. past and future loss of income
2. past and future medical expenses
3. past and future loss of ability to do housekeeping work
4. pain, suffering and loss of enjoyment of life

The Minor Injury Cap only applies to item 4 – compensation for pain, suffering and loss of enjoyment of life. You are entitled to full compensation for items 1, 2 and 3.

What is the maximum amount of benefits?

The maximum amounts of compensation vary from province to province:

• NS – 7500 indexed
• NB – 2500
• PEI – 2500

“Indexed” means the cap is adjusted for inflation every year, to account for the rising cost of goods and services.

If you have suffered a minor personal injury as defined by the government regulations, then you would be entitled, depending on your province, to the maximum listed above as compensation for pain, suffering and loss of enjoyment of life.
